Terms and conditions for the purchase of tickets, classes, courses, studio hire, and the use of The Cockpit website.

We do our best to ensure that all the information on our website is current and accurate. However, mistakes can occur, so we would encourage anyone who may be thinking of making a special trip based on information displayed on the website to confirm that the information is correct. You can do this by emailing  receptionatthecockpit.org.uk

Now for the legal information:

1. DEFINITIONS

In these terms and conditions the following words shall have the meanings set out below:

1.1 "Confirmation" means the confirmation email sent to you by us acknowledging your booking and setting out the details of your booking.

1.2  "Contract" means any contract for the purchase of tickets, space hire, courses or classes made between you and The Cockpit (acting as agent for the relevant Third Party in those cases where a Third Party Event is the subject of the Ticket).

1.3  “The Cockpit” means The Cockpit, Gateforth Street, NW8 8EH, a theatre owned by City of Westminster College   www.cwc.ac.uk

1.4 "Online Booking Form" means the series of pages for the booking of tickets or other products set out on The Cockpit website.

1.5 “Third Party” means a party other than you and The Cockpit.

1.6 “Third Party Event” means an event organised by a Third Party in respect of which the The Cockpit is acting as ticketing agent only.

1.7 "Ticket" means any ticket for attending a live, staged performance at The Cockpit offered for sale by the The Cockpit or its authorised agents.

2. GENERAL

2.1 These terms and conditions relate to the purchase and supply of Tickets, classes, courses and space hire and the use of The Cockpit website generally. Please read these terms and conditions carefully before purchasing any of our products or services. By making a purchase, you accept and agree that these terms and conditions will govern all contracts and agreements.

2.2  Nothing in these terms and conditions is intended to affect your statutory rights.

2.3. These terms and conditions do not necessarily all apply to auditorium hires by incoming theatre companies for which separate terms and conditions apply as detailed in Theatre Hire contracts.

3. PURCHASING TICKETS, CLASSES, COURSES AND STUDIO/ROOM HIRE

3.1. If you make a group booking, you accept these terms and conditions on behalf of all members of the group and are responsible for all payments due to you or us from the party.

3.2. Only persons who are at least 18 years of age are permitted to purchase our products or services. By booking tickets you warrant that you comply with this requirement.

3.3. If there are any changes to your details once your booking has been concluded then it is your responsibility to inform The Cockpit.

3.4. The Cockpit reserves the right to place restrictions on:

3.4.1. The volume of any tickets ordered.

3.4.2. The number of places booked for classes or courses or the number of people who use any of our studios or facilities

In addition, The Cockpit shall be entitled to terminate ticket sales for a performance or sales of courses, classes or studio slots or a Third Party Event at such time as it shall think fit (or as directed by any relevant Third Party).

3.5. It is your responsibility to check that any tickets issued to you or sales made to you are for products you want.

3.6. Any purchase of products or services is only valid when processed by The Cockpit or an agent authorised by The Cockpit.

3.7. Recorded/Live Broadcast Events

3.7.1. By taking part in a broadcast/recording, you grant The Cockpit the right to use footage or imagery resulting from this recording including video/sound recordings of you and any reproductions or adaptations of the footage or imagery for all general purposes including the right to use them for TV, promotional films, online and in any publicity materials, newspapers, magazine articles and social marketing.

3.7.2. Footage may be stored on a third party server (Vimeo), with access restricted to relevant staff only. There is no public access to these files.

3.7.3. Nothing filmed will be lent, hired or sold on by The Cockpit to any third party.  However The Cockpit is unable to affect the status of anything owned by google, facebook or other Sm platform as a result of  those platforms being used for distribution. If you do not wish to take part in this footage;

Instructions on how to hide yourself from a zoom audience:

When you join the Zoom meeting, click 'join with computer audio'.

Do not click 'start video' or 'unmute'.  This means you cannot be seen or heard by others in the Zoom meeting, but you can hear and see others.

If you already clicked 'start video' or 'unmute', you can turn them off by clicking 'mute' and 'stop video' at the bottom left of the Zoom window.

If you would like your name not to be seen by others, click 'participants' at the bottom centre of the Zoom window, and a list of participants will show on the right hand side of the window.  Click the blue 'more' button to the right of your name, and choose 'rename'.  You can update your name here, and click 'rename' to save your changes.

3.8. Online classes are recorded for training and quality control purposes but it is not our practice to keep or distribute or broadcast recordings in any way. No footage will ever be lent, sold or given to any third party.  Promotional extracts may be used to promote the class/course and/or The Cockpit but your express permission will be asked for in advance of this happening.

4. REFUNDS

4.1  Show Tickets

Tickets for shows are not refundable.  

4.2 By purchasing a ticket to a show, you shall be deemed to consent to your being filmed where the event or performance is being filmed

4.3 The Cockpit reserves the right to ask for proof of eligibility for concessions at the access points for any show, class, course or period of studio hire.

4.4 Courses & Classes

4.4.1 Drop In Classes A full refund can be issued if we are given more than 24 hours notice.

4.4.2 All other Cockpit run Classes All deposits are non-refundable. We will accept other refund requests subject to a 15% admin charge (minimum £10 per course) up to 10 working days before the first session.

Late payment

We may charge you reasonable administration costs as a result of late payment or failure to pay. Continual late payment may result in removal from the payment scheme and a demand of upfront payment.

4.5 Refunds for Studio Hires

We accept cancellations where notice is given by email 10 or more working days in advance. We will refund the fee paid minus a 15% admin charge (minimum of £8). Cancellations with less than two weeks notice are charged at full rate.

5. TRANSFERS TO ANOTHER PERSON

5.1.You may transfer a show ticket to someone else but you should notify us if you do . Any application by you to transfer a ticket to another ticket holder must be notified to us 24 hours before the start of the event. Email receptionatthecockpit.org.uk . You will need to pass your booking reference number to whoever you wish to use your ticket. They may need ID at the door and we may, at our discretion, not allow a particular transfer in any particular instance.

5.2. No purchase for any of our products or services may be transferred or resold for commercial purposes or at a premium. In the event of breach of this condition, the bearer of the ticket or the person claiming the right to attend the class, course or use the space hired will be refused admission.

6. DATE TRANSFERS

6.1. Show tickets

6.1.1 You can apply to us to change a ticket to another date up to 24 hours before the show. If we are able to, we will change the booking to another date within the same run. Application to change a ticket date should be made within box-office hours either by phone 0207 258 2925 or in person. We are sorry but where no other dates for the same show are available we are not able to change or refund your ticket.

6.1.2 We are sorry but where a discount code has been used we are not able to change or refund tickets. 

6.2. Courses and classes

6.2.1 Drop In Classes Transfers can  be made within the same class and with more than 24 hours notice only. We reserve the right to refuse a transfer if booking for the requested date has not yet opened.

6.2.2 All other Cockpit run Classes We will accept transfer requests within the same class/course subject to availability and a 15% admin charge (minimum £10 per course) up to 10 working days before the first session.

6.3. Studio hire

6.3.1 We will accept applications to reschedule your booking, subject to availability and if given more than 24 hours notice. Transfers are made at our discretion and are subject to a 15% admin charge (minimum of £10).

7. ADDITIONAL PROVISIONS APPLYING TO TICKETS AND CLASSES/COURSES PURCHASED ON THE COCKPIT’S WEBSITE

7.1 The Cockpit (or the relevant Third Party) shall be entitled to make changes as to speakers, performers, running times and such other matters as it thinks fit in the case of any event, including classes and courses.

7.2 . The website www.Thecockpit.org.uk  is owned and operated by The Cockpit.

7.3  If you choose to purchase products, tickets, classes, courses or studio hire via The Cockpit website, your Contract  will be concluded as follows:

7.3.1. Completion and submission of the Online Booking Form shall constitute an offer by you to purchase subject to these terms and conditions. You can correct any mistakes you make when filling out the Online Booking Form at any point before submitting it;

7.3.2. Once you submit the Online Booking Form, our box-office system partner, Monad, will pass your application to make a purchase to a secure payment processing agent, PayPal, to take payment. Once payment has been taken, an on-screen confirmation will be displayed and The Cockpit will send you a Confirmation as soon as possible. This Confirmation shall constitute The Cockpit’s acceptance of your booking. A Contract will be formed once you have received the Confirmation;

7.3.3. if the Cockpit receives a prompt notification that the Confirmation was not delivered successfully, then The Cockpit will use reasonable endeavours to notify you of its acceptance and the details of your booking by other means.

7.3.4. The only language available for the conclusion of a Contract online is English.

7.3.5.  Details of all Contracts concluded online (not including the card details) will be kept on file by us and can be provided to you upon request.

7.3.6. You are entirely responsible for entering your details correctly on the Online Booking Form.  By submitting an Online Booking Form you warrant to The Cockpit that all details supplied by you are true and accurate.

8. PRICE AND PAYMENT

8.1. The price (including all taxes where relevant) of all products and services are specified on the The Cockpit website. These details are based on the best available information to the The Cockpit and The Cockpit is not obliged to conclude any Contract on these terms.

8.2. The price of all products and services booked over the phone, in person or by post are displayed on the The Cockpit website and/or will be provided to you at the time of booking. These details are based on the best available information to The Cockpit and The Cockpit is not obliged to conclude any Contract on these terms.

8.3. For bookings made over the phone, via email, in person, or by post The Cockpit accepts payment by most cards, cheque and BACS  (save in the case of a Third Party Event, unless The Cockpit and the Third Party determine otherwise) We cannot undertake to process all cards where national exclusions or other limits imposed by our transaction processing partner(s) apply.

8.4. If your purchase is being made using a third party credit/debit card you must provide The Cockpit with written authorisation from the card holder.

8.5. We charge booking fees on most tickets and some other items. This is to cover the fees we pay to third parties facilitating the transaction. EG Visa, Worldpay, or box-office serve provider etc etc. Sometimes booking fees will be shown seperately to prices, sometimes they will rolled up within the total price shown.

9. TICKETS

9.1.  Entrance tickets to the auditorium will be given to you on your arrival at The Cockpit. We do not post out tickets and paper tickets can only be collected one hour before the event or from 6pm - whichever is earliest. Your confirmation will include a booking reference number which will entitle you to entry at the appointed date/time. It is your responsibility to either print off your emailed confirmation or record your booking reference number.

10. CANCELLATION POLICY

10.1. The Cockpit will not refund your purchase except in the following cases:

10.1.2. Where The Cockpit or the relevant Third Party is unable to perform a Contract on the date(s) agreed because the performance/class/course/studio space in question is no longer available or viable, or is closed by The Cockpit, The Cockpit will refund to you the face value of the purchase (excluding any delivery charges).

10.1.3. Where a performance has been cancelled or abandoned when more than half of the performance has taken place The Cockpit may, in its discretion (and provided any relevant Third Party agrees), refund to you the face value of the Tickets purchased (excluding any delivery charges).

10.2. The Cockpit will endeavour to issue a refund to you using the same method of payment that you used to make the purchase.

11. ALTERATIONS

11.1 All show tickets, classes and courses are sold subject to The Cockpit’s right to make any alterations in the cast or programme details advertised on The Cockpit’s website or other appropriate location.

12. LIABILITIES OF THE COCKPIT

12.1. Subject to clause 12.3 below, The Cockpit (or any relevant Third Party) will only be liable to you for direct and foreseeable losses arising as a result of:

12.1.1. a breach of these terms and conditions; or

12.1.2. any negligent act arising under or in connection with the Contract.

12.2. The Cockpit’s (or the relevant third Party’s) total liability under clause 12.1 above shall be limited to the total face value of the purchase.

12.3. Nothing in this clause 12 excludes or limits liability for death, personal injury or fraud.

12.4. The Cockpit (or any relevant Third Party) will not be liable in any way if it is prevented from performing its obligations under or arising from any Contract due to any factors which are beyond its reasonable control. Without limiting the foregoing, the following shall be regarded as causes beyond its reasonable control:

12.4.1. Acts of god, which include earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost;

12.4.2. Force majeure which includes war, accidents, acts of public enemies, strikes, embargoes, perils of the air, local disputes and civil commotions;

12.4.3. Power failure and failure of sound or lighting equipment.

12.5. The Cockpit will not be liable for any losses incurred by you in connection with your use of The Cockpit’s website, for any delay in using or your inability to use the website, for any information or Tickets obtained through the website or for any material posted to the website by The Cockpit or by users of the website.

13. WEBSITE USE

13.1. The Cockpit’s website is for your own personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from the Cockpit’s website.

13.2. The contents of The Cockpit’s website, including any software, are protected by intellectual property rights and other related rights. No part of the Cockpit’s website may be reproduced in any form (electronically or otherwise) without the prior consent of The Cockpit, other than temporarily in the course of using The Cockpit’s booking service or as permitted by law.

13.3. You are not permitted to link to or use all or any part of The Cockpit’s website for any purpose which is unlawful, defamatory, harmful, obscene or objectionable.

13.4. You are not permitted to transmit anything which, in The Cockpit’s opinion, harms The Cockpit’s business or in any way offends other users or persons.

13.5. You are not permitted to alter The Cockpit’s website in any way except as allowed under our arrangements for visiting company use. Any such use is subject to our editorial approval and we reserve the right to change or remove any information uploaded by visiting companies or parties other than The Cockpit at any time.

13.6. You must not post onto or transmit to The Cockpit’s website any material containing software viruses or files which may damage or disrupt the good working order of computer or telecommunications equipment.

13.7. The Cockpit reserves the right to refuse to post onto or remove anything from its website which, in The Cockpit’s opinion, is objectionable or does not comply with these terms and conditions. The Cockpit shall not in any way be liable for such actions.

13.8. The Cockpit may record, preserve, trace and disclose anything which has been transmitted to, from or via The Cockpit’s website where required by law or where The Cockpit is acting in good faith.

13.9. If you create, or are provided with, a username, password or any other piece of information as part of The Cockpit’s security procedures, you must treat this information as confidential. In particular, you must not disclose this information to any third party.

14. LINKS TO THIRD PARTY SITES

14.1 Our website may contain hyperlinks to websites operated by parties other than The Cockpit. The operation of such websites is outside The Cockpit’s control and you proceed at your own risk. The Cockpit does not endorse or sponsor and is not liable for the products, services or content you access through any linked site.

15. DATA PROTECTION

15.1 The Cockpit will collect, use, store and disclose your personal details. But not to any third party unless required to do so by law or in the course of a purchase by you.

16. CONTACT AND COMPLAINTS

16.1 If you need to contact The Cockpit, or if you wish to complain about your experience purchasing something using the Cockpit’s website, you can do so using any of the following methods:

17. ENTIRE AGREEMENT

17.1 All the terms of any Contract are contained or are referred to within these terms and conditions.

18. SEVERABILITY

18.1 If any part of these terms and conditions is held to be unenforceable this will not affect the enforceability of the remaining provisions.

19. SAFETY AND ENJOYMENT

19.1. The Cockpit reserves the right to refuse admission and may request anyone to leave (taking any such appropriate action which may be necessary to enforce this right) before or during activities if it considers it to be necessary or desirable to do so. The Cockpit (or the relevant Third Party) may also, on certain occasions, have to conduct security searches to ensure the safety of its patrons.

19.2. Latecomers will be asked to wait until a suitable break in the activity before being admitted.

19.3. Alcohol, cans or glass drinks containers may not be brought into the auditorium unless composed of toughened material as supplied from The Cockpit bar

19.4. Mobile phones and other electronic equipment must be switched off (not silenced) before entering activities.

19.5. To be admitted to any show you must hold a valid ticket. To be admitted to any Cockpit run class or course, or to use any of our studios, you must have paid in advance.

19.6. Unless a performance is expressly stated to permit entry to children under the age of five, you should assume the activity is not suitable for very young children or babies.

19.7. Please note that strobe lighting, smoke effects, cigarettes and gunshots are sometimes used in productions.

19.8. The Cockpit and any authorised third parties may carry out general filming and sound recording in or about the venue. By purchasing any of our products or services you consent to you and your party being included in and to the commercial exploitation of such films and recordings without payment.

20. THIRD PARTIES

20.1 Nothing contained in any Contract is intended to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any third party.

21. GOVERNING LAW

21.1 These terms and conditions and any Contract concluded incorporating these terms and conditions shall be governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.
